Authorization to sign the Basic Asset Protection Agreement (BAPA) and increase the purchase order (PO) to direct payments of up to £79,100 for BAPA to Network Rail on Templeton Road Before on-site construction can begin, the Council must sign the BAPA and pay Network Rail directly for BAPA and related works. The order (PO) needs to be increased, as BAPA costs were only estimated by Network Rail and increased until the end of construction due to the additional workload for monitoring the dam and bridge. • To enter into a dispute with Kind Diamond regarding liability for BAPA`s fees. However, the Treaty has remained silent on these costs and, as such, the Council has no legal basis for expecting Kind Diamond to pay them. This option was therefore rejected. • Renewal of kind Diamond`s contract so that network Rail can be paid for the necessary work. This option was rejected because it would cost more, require administrative costs for Kind Diamond and because it would be less efficient. . . .
